  • Detailed description of property, including FiberTek Insulation, is presented for annexation proposal

The Foothill Industrial Park, where FiberTEK Insulation is building a plant, is seeking annexation into Nephi City.
“The proposed annexation takes in the property on the west side of the railroad tracks all of the way to Elevator Road,” said Randy McKnight, city administrator.
It follows parallel to Elevator Road east to the highway.
The south boundary is shared with the property owned by the National Guard.
The boundary on the east is on the east side of the highway leading to Levan. Known as SR-28, this is the highway that continues north through Levan to Nephi, where it intersects I-15 at the south end of the city and continues north along the former Business Loop through Nephi, ending at an junction with I-15 north of the town.
“The property in the proposed annexation does overlap the highway,” said McKnight.
“Does it matter that the road is inside the annexed property?” asked Chad Bowles, city council member.
McKnight said that state highway system officials did not care if the property was in the city or in the county. State Statute exempts state highways from taxes and maintenance would remain the same.
FiberTEK is seeking annexation as a limited lability LLC.
Americans have the ability to form a limited liability company which is a type of business ownership combining several features of corporation and partnership structures.
Owners of a LLC have the liability protection of a corporation. A LLC exists as a separate entity much like a corporation but members cannot be held personally liable for debts unless they have signed a personal guarantee.
“The property the Foothill Industrial Park is seeking to annex comprises 63 acres in south Nephi,” said McKnight.
Ivan Radman, who began the fiberglass insulation business, serves as the manager of the limited liability LLC.
According to Utah Municipal Code 10-2-402, which addresses annexation limitations, unincorporated county property cannot be annexed into a municipality if it would create an island of unincorporated county property. The property must be contiguous to existing city limits.
State code directs that an unincorporated area contiguous to a municipality may be annexed to the municipality if the area is within the proposed annexing municipality’s expansion area.
The proposed annexation is within the expansion area identified in Nephi’s annexation policy,” said McKnight.
A municipality may not annex an unincorporated area unless a petition is filed requesting annexation since, by state law, the process to annex an unincorporated area to a municipality must be initiated by petition. 
Those intending to file a petition are required to file with the city recorder of the proposed annexing municipality a notice of intent to file a petition and send a copy of the notice of intent to each affected entity.
The petition must also include an accurate map of the area that is proposed to be annexed.
    Nephi City Council, by majority vote, agreed to accept the annexation petition for further consideration.
“This is just a first step in annexing the property,” said McKnight.
