A canvass of the votes cast in the November 6 election
was given by Town Clerk Rachelle Bryan. The Council accepted
the canvass as read.
Mayor Andrew Robinson asked for authorization
from the Town Council to purchase candy for two Christmas
Parties held in the community. The date of December 7 was
set for a party for all Town employees and officials.
Alden Shurtz stated that he had a concern that
went back to the Meet the Candidates meeting. Shurtz said he
wanted it in the record that when he and Rachelle Bryan
cleaned out the file cabinets at the Town office there was
nothing thrown away having to do with water contracts. Bryan
stated that the County Clerk was called to see what needed
to be kept in the file and for how long. They were
instructed to keep anything having to do with water for
life. "We went through each individual file when we did it."
said Bryan. "We threw away no water contracts, no unsigned
documents. She called the County, she called the State, she
called everyone we needed to call." said Shurtz. "Had it of
been a file cabinet that needed to be maintained properly,
they should have already retained it and had a date on it
when it expired. In my opinion, had it been taken care of
and cleaned up and the office run the way it should have
been, we wouldn't have had to spend hours cleaning it up."
said Bryan.
Mayor Robinson said "Unfortunately some things were
said that just weren't true. I want to make one statement
pertaining to that
over the course of the last four
years the Town has faithfully complied with every element of
this contract with the Irrigation Company. As well, the
Irrigation Company has faithfully complied with every
element of the contract that it has with us. And for the
record, we are working off a contract that's probably 15
years old. The contract that was alluded to during that
session was never validated nor signed. So we work off the
contract that was the original contract that was signed by
Golden Mangelson as mayor and Bob Shepherd over the water
department, and that's the contract that the Town fully
abides by and complies with."
Rod Wankier said the only reason he brought that up
was there was a contract they were working on in '96 that
didn't get approved and didn't get signed. He was led to
believe the '96 contract was the one they were operating
from and he could never find a signed copy.
Robinson asked Council member Shurtz (who is
over the garbage collection for Levan) if he was "fully
aware that we had made arrangements with Nephi to obtain a
garbage truck, or did you know that?" "I did not know that."
said Shurtz. "Nephi has given us their garbage truck.
Actually, Rod made the arrangements and spoke with Mayor
Brough. We are going to get a free truck. We just have to
maintain it and that will improve our garbage service. We
are going to go for it." In further discussion, Mayor
Robinson said that Levan will maintain and use the garbage
truck and Nephi will have a back up truck if their brand new
garbage truck should ever have problems. The truck is on
loan from Nephi.
Craig Worwood said, "We've tried to increase our
water. For the last year and a half we've been working on
this. It's going to be protested. Right now the water will
increase from 350 gallons per minute to 575." In further
discussion, Worwood stated that we can increase our water
flow for the Town right by claiming Rose Bush. A discussion
on water rights followed.
The Council went in to an executive session after
which the meeting was adjourned.
