Nephi City Council adopted a revised district
description of the Combined Use 2 (CU-2) district in the
Nephi City zoning ordinance.
The revisions have been the subject of a public
hearing. There were only four people, other than council
members, in attendance at that hearing and no public comment
was received opposing the proposal.
"The buffer zone has been carefully considered and
discussed by the city council," said Chad Brough, mayor.
"For the most part, this proposal looks good."
He said, since the public hearing had been held, the
council could now consider the changes and adopt them, which
the council did, unanimously.
Brough said some of the changes were a revised
combined use district CU-2 in which uses for the buffer zone
concept were deleted, In addition, added language on
residential facilities had been added.
In the Combined Use-II District CU-2 proposal some
uses have been eliminated.
With adoption, it is no longer be possible to have a
small animal hospital, automotive repairs, automotive
service and self-service, convenience goods and service,
general comparison merchandise sales and service, home
furnishing sales, hotel, motel, liquor store, R.V. Park, or
a restaurant or drive-in inside the zone.
Still allowed are agriculture, dry cleaning
establishments, laundromats, offices for business,
government or professional uses, parking lots, personal
services, preschools, public parks and recreation
facilities, public service, public utility stations, repair
services, single-family dwellings, two-three-and four-family
dwellings, wholesale, warehouse, storage, residential
facilities for person with a disability and for elderly
persons.
"No particular property was considered in proposing
the changes," said Brough. "The changes affect all property
in the changed zones."
Language to allow residential facilities for persons
with a disability or for elderly persons, since they may be
required to be reasonably dispersed throughout the
community, will be added to zones CU, R-1; R-1-8; R-1-H; R-1
5, R-2; R-2-8; and R-3.
The dwelling unit concept and a second kitchen permit
are now possible.
Zero-lot-line development as an allowed use is being
added as an allowed use in the R-1-8 district.
"We also made editing changes and corrected wording
and clerical errors in the zoning ordinance," said
Brough.
In addition, the changes the council approved will
allow a home to have a second kitchen which has not been an
allowed use in the zoning ordinance for a single-family
residence.
The zero-lot-line development will allow the
development of twin homes.
Single family dwellings may be arranged on two lots
sharing a common wall.
One stipulation, however, is that in areas where
multiple family dwellings are allowed, no two- three- or
four-family dwellings will be located closer than 750 feet
from another such dwelling.
