The Levan road improvement project in Juab County
demands that some sections of the existing road be abandoned
so that the road can be straightened.
Jared Eldridge, county attorney, suggested the
commission set a public hearing. The commission did so and
decided that public hearing, to take public comment, should
be held on March 3, at 6 p.m.
Eldridge told commissioners that, with their approval,
the road abandonment noticing required by state law was
ready to be implemented.
"A legal notice needs to be in a newspaper, the
Times-News, of general circulation four consecutive weeks
before the public hearing," he said.
In addition, everyone with adjacent property needs to
be notified by letter, he said.
Perry Davis, a deputy county attorney, is making
certain that all of the legal requirements are met, said
Eldridge.
In setting the public hearing, Eldridge suggested the
commission err on the side of caution and make certain that
exactly 30 days (four weeks) had passed between the first
advertisement and the date of the hearing.
The road abandonment proposal doesn't actually call
for a long segment to be discontinued, said Robert Steele,
commissioner. Rather several small pieces will be set aside
in favor of other portions which will make the road
straighter.
"This is the Levan by-pass road which will go around
rather than through the community," said Steele.
The object of the by-pass is that truck traffic from a
mine east of the community will no longer be forced to use
the streets of the city.
Eldridge said that a map of the road, showing the
intent to abandon certain sections, had been prepared and
was on file in the county clerk's office for those who
wanted to review the proposed changes prior to the public
hearing.
Robert Garrett, county road superintendent, told
commissioners that the change in alignment required some
cooperation from the irrigation company which takes water
from the canyon in that some lines had to be changed.
