Nephi City will now have complete control of city
streets along on 300 West from 700 North to 1500 North.
Juab County Commissioners agreed Monday to allow the
property to be deeded to Nephi City.
"Often times, when a city grows, and existing county
roads are annexed into the city," said Randy McKnight, city
administrator, "the county may own the right-of-way."
In those circumstances, the policy of the county has
been to deed the right-of-way property to the city so that
the city may have control of those roads as city
specifications for the roads are met.
Sometimes, he said, the county may own the property
under the roadway.
McKnight showed commission members the city street map
so they would understand just where the roads were and what
property actually belonged to the county.
It just makes sense, he said, that the county not have
control of the property when the city is making the rules
that govern the road such as widths, for example.
"As we adjust the boundaries of city streets, maintain
them and provide snow removal, it makes sense that the
property belong to the city," said McKnight.
The road, he said, crosses the railroad tracks, west
of Nephi, goes past Nephi Pack, the Howard Orchard and back
to the industrial park.
"There are places where the county has the
right-of-way, and some places where the county does not," he
said.
The county recorder had researched all of the property
ownership for the roadway and had determined what the county
owned and what it did not. It was his recommendation that
the county deed those pieces that still belonged to the
county to Nephi City.
"I thought it was already a city street," said Robert
Steele, commissioner.
McKnight said he had given a deed proposal to Jared
Eldridge, county attorney, to review.
"It seems pretty straightforward," said Eldridge. He
said he had no problem with the county adopting the proposal
and deeding the property to the city for their road
system.
Steele then made the motion, which was unanimously
agreed to, to allow the transfer or conveyance of all county
property involved with the roads to Nephi City to become
part of the city street system.
It will now be Nephi's responsibility to maintain the
street.
