  • Nephi will enforce ATV ordinance

Nephi City Council members approved an ordinance allowing four-wheel vehicles to travel on designated streets within the city and imposing several conditions on such travel.

"The off-highway vehicle ordinance adopted by the council last year has expired and must be re-adopted if the use of city streets by off-road vehicles is to continue to be authorized," said Chad Brough, mayor.

"The council placed the ordinance in effect last year on a one-year probation to see how it would work out," said Brough.

Some of the city's residents seem not to understand that the ordinance can be revised or rescinded on a vote of the council, he said. He said the council had talked about the ordinance renewal at work meetings and had decided to keep it in effect until they saw problems with it that were out of hand.

At that time, he said, the ordinance could be revised or done away with, as the situation dictated.

"We set up the route, mostly for young people to get in and out of town. It is not designated for travel to the store or to get gas," he said. "We didn't have this for our youth and we want the youth of the community to know that the privilege can be taken away if it is abused."

The council agreed to the adoption of the ordinance on a more-or-less permanent basis but will address the ordinance, like all ordinances, on a periodic basis or as problems arise.

"We would like to urge all of the riders to stay on the existing asphalt, keeping as far to the right as possible, while still staying on the asphalt," said Brough.

Those taking advantage of the route should remember that there are only certain streets eligible for use, there is a 15 mph speed limit for such use, and off-highway vehicles must be appropriately equipped and registered.

All licensing requirements apply.

"It is also important for all to remember that safety certificates, safety equipment, and adult supervision are required for riders ages 8 to 15," said Brough. "No one under age eight may operate an off-highway vehicle on a public street."
