  • City council discusses combined use area during work session

Chapter 7 of the Nephi City general plan has been the recent focus of the city planning commission and was discussed in the work meeting portion of city council meeting.

Shauna Talbot, city planner, attended the council meeting to explain the uses being considered and the changes being recommended by the planning commission. Also present was Karl Brough, representing the planning commission.

“In a combined use district (CU), no building or land may be used, and no building erected which is arranged, intended or designed to be used for other than approved uses, which may be required to be reasonably dispersed throughout the community,” said Talbot.

The zone is basically from 900 North to 700 South.

“You have talked about Main Street,” said Donald Ball. “You haven’t talked much about Track Street (100 North). How far east and west would a combined use go--from the edges of town to 400 East and then again from 400 West?”

The combined use district (CU) is established to allow commercial development and some limited higher density residential uses along major traffic thoroughfares and to provide standards to assure quality development and efficient traffic flow, said Talbot

“We are proposing removing Agriculture; Animal hospital; Athletic, tennis or racquet clubs; Auto, truck, recreational vehicle and equipment rental; Automotive repair; Automotive service and self-service; Banking or financial service; Bar, lounge, club; Cinema, indoor; and Convenience goods and service,” said Talbot.

Still allowed will be Advertising Services; Antique Store; Apparel and accessory clothing or shoe store; Art Gallery/Artist Studio; Assembly buildings (public and private); Bakery, Retail; Book store, stationery and hobby supplies; Catering, food services; Church, except temporary revival tent or building; Civic or cultural club; Construction services including a show room or office but the storage of materials must be contained within a storage building that meets all applicable safety, fire, and hazard codes.

Counseling services (such as therapy, nutrition, life coaching); Craft store, or craft production (on-site, customer produced) including, but not limited to; pottery, painting, woodcrafts, sewing; no outdoor odors or outside storage; Cultural, civic services; Daycare, family; Daycare, group; and Dry cleaning establishments.

“We have discussed the need for dwellings such as a duplex or a triplex in the CU zone,” said Talbot. “We did reduce how tall they can be. They are to be no more than 45-feet.”

Those units can be vertical/stacked with a minimum of 800 square feet per unit, and not to exceed 2,500 square feet per unit, and a maximum of eight dwelling units per building, with a maximum total building size to not exceed 15,000 square feet,

The maximum building site footprint per building is 5,000 square feet.

“We have also discussed requirements for dwellings, or apartments above commercial businesses (including studio apartments) with a minimum of 800 square feet per unit, and not to exceed 2,500 square feet per unit,” said Talbot.

“The dwelling area is not to exceed 50 percent of the building space with a maximum of four dwelling units per building. The maximum total building size is not to exceed 15,000 square feet with the maximum building site footprint per building being 5,000 square feet,” she said.

Allowed CU uses are: Dwellings, Single Family; Electrical Appliance Repair, service and sales; Employment Services; Entertainment Center including, but not limited to, arcade, laser-tag, virtual reality, ax-throwing, escape room; Furniture, home furnishings, appliances, and equipment (all supplies and equipment need to be stored within a storage building that meets all applicable safety, fire, and hazard codes.

Gardening Center for the sale of plants, trees, shrubs, gardening supplies, and implements; Gardening, Horticulture, and Landscaping; General comparison merchandise sales and service; Government or quasi-government services; Grocery, Supermarket, or Food Store (neighborhood); Gym, Health club, or spa; Hardware Store; Hotel, motel; Home furnishing sales; Home occupations; Instructional academy; Instructional academy, home (such as a preschool); Jewelry store including watch, clock, jewelry repair, and engraving; Laundromat; Liquor store.

“We removed a few uses,” said Talbot. “Some were because of traffic impacts.”

Not allowed in a combined use are: Healthcare centers; Hospital; Industry, light; Interior accessory dwelling unit; Lumber sales and storage; Multiple-family dwelling; Parking lot, public or private; Personal services; Residential facilities for persons with a disability (as defined); Residential facility for elderly persons (as defined); Shopping center; Wholesale, warehouse, storage; Zero lot line development.

Businesses allowed are: Medical Treatment Offices including, but not limited to; physician clinic, dentist, optometrist, physical therapy, chiropractic, ultrasound, massage therapy, Lasik eye center, hearing treatment center; Miscellaneous personal services; Miscellaneous small item repair services (no odors, or outside storage); Miscellaneous retail trade (no odors, or outside storage); Model home sales office; Mortuary, funeral home; Music store; Office including business, or government or professional.

Combined use allows: Pet Grooming (completely enclosed within building, no outside kennels, or animal pens); Pet Store (completely enclosed within building, no outside kennels, or animal pens); Pharmacy; Photography, photographic processing or supply, and picture framing; Planned residential development; Printing and Publishing; Public park and recreation facilities; Public service; Public utility station.

It also allows: Repair or alteration services including clothing, or shoes; Restaurant, traditional (not drive-in); Service Salon, including tanning, hair, barber, esthetic, nails; Schools, public or private; Senior citizens center; Shipping, Delivery, Mail, Printing and other temporary office services; Sporting goods store including: bicycles, bow shop, kayaks, and like recreation items; Theater, cinema, or concert hall; Thrift Store, (Second-hand store); Veterinarian services or clinic (for small animals only on-site).
