Procedure for adopting a budget for a special service
district requires that the governing body of the group hold
a board meeting and vote to accept or reject the proposed
budget by a vote.
Juab County Commissioners, while they need the proposed
budget adopted by the special service district to plug into
the county budget, do not have the authority to propose or
adopt the budget for the districts.
The county has two special service districts&emdash;one
to deal with funds for the museum and another to manage
mineral lease money.
"If we must adopt the budget, we need to adopt by a vote
of the board members. We then need a quorum," said Joseph
Bernini, commissioner.
"There must be an advertised public hearing and an
advertised board meeting," said David Leavitt, county
attorney. "A meeting would require an agenda to act on the
proposal. It's a ticky-tack item."
A hearing of the board would be just that, said Leavitt.
It would not be a hearing of the commission.
The meetings were kept legal by the fact they had been
advertised in a local circulation newspaper and in
traditionally used public advertisement spots. The meetings
had also been advertised as public hearings on the specific
issues being addressed.
The first special service district hearing required a
vote of the
missing board&emdash;only one member was
present&emdash;which could not take place at the end of the
public hearing. The notes of the meeting will be used to
read to the board. After they have reviewed the notes, the
board will call for a vote.
"The hearing will be under the direction of the chair of
the special service district," said Leavitt.
Joseph Bernini, as chair of District No. 2, called the
meeting to order to vote a proposed 2000 budget to come from
mineral lease money.
The fire district, which will need a boost from county
funds, will need money to start. The biggest amount will
need to be paid for ballots and election materials to have
the proposed fire district placed on the ballot this
fall.
"Would it be possible to take $2,000 out of the county
budget to put into the 2000 fire district budget ?" asked
Robert Steele, commissioner.
The money would give the hoped-for project funds to use
to get ready for a ballot-election vote this coming
fall.
"The mineral lease money was originally set up for
roads," said Robert Garrett, county roads superintendent. "I
would like to see the board put some money back on roads. It
should, especially, be used for the Brush-Wellman Road,
which is used mostly for mineral deposit transport."
A quorum of Special Service District #2 board was present
to vote&emdash;Jean Bowles, Glenn Greenhalgh, Craig Sperry,
and Joseph Bernini.
Shirleen Newell was the only board member present for the
special service district #1 and she is a non-voting member
of that board.
"There are two capital projects funds for two
projects&emdash;the county fairgrounds and the county fire
district," said Bernini.
"The county should put $2,500 in the special projects
fund for the year 2000," said Glenn Greenhalgh, economic
director for the county and a member of Special Service
District #2.
"The fire district will need to adopt a budget for the
year 2000," said Leavitt.
