  • Commission tackles codification of county ordinances

A draft copy of the codification of Juab County ordinances was presented to the county commission for the commission to study before adopting.

"My guess is that there are things that you may want to change," said David Leavitt, county attorney. "We have given it our best shot and it represents a good deal of work but that doesn't mean you will agree with everything."

Commissioners will study the work and make recommendations at the next commission meeting, Monday Dec. 20.

"I would like to recommend a change right now," said Robert Steele, commissioner. "The ordinance doesn't specifically name RS2477 roads in the wording."

Leavitt said the wording was specifically selected to reflect a county government attitude that all county roads would be considered equal by commissioners. Deeded roads, use by prescription roads, and RS2477 roads were all the same in the ordinance.

"We can put the RS2477 road designation in the ordinance in the definition of roads," said Leavitt.

Steele said that would make him more content with the definition of roads and would, in his estimation, close a loophole that may occur if the wording were left as is.

The 161 page document would take some time for commissioners to read, said Wm. Boyd Howarth, commission chair. However, he said, the commission would try to have the reading done post haste so the document could be prepared, in a final form, for adoption before the new year.

"It is prepared so that single pages can be changed without having to redo the entire document," said Howarth.

Leavitt said the ordinances are all on the county computer system and, at any time, an ordinance can be changed without all ordinances having to be changed at the same time.

"The codification of our ordinances was long over-do," said Leavitt. "They needed to be updated."

There are several headings under which the ordinances have been arranged such as administration, amusements, animal control regulations, building, franchises, disaster response and emergency management.

There are also ordinances to cover fire prevention and business regulations, nuisances, offenses and miscellaneous provisions, roads and highways, sewers, wells, shafts, solid waster, taxation and traffic.

There are general provisions, a county development code, and an historic preservation commission all included in the draft ordinances.

"This will take more than just light reading," said Joseph Bernini, commissioner.
