Juab County Commissioners voted to amend the county
zoning ordinance following a public hearing held Wednesday
which only two interested citizens attended.
Juab County has had a prohibition against outdoor
advertising signs, that does not fit with state law.
Graham Misbach and his wife attended the meeting as
interested members of the public but only Graham Misbach
addressed the commission in the public meeting.
"The planning commission proposed four basic changes,"
said Glenn Greenhalgh, county planning commission director.
"These clarifications and minor revisions are recommended by
them."
Greenhalgh the changes were recommended as a result of
increased interest and pressure and a determination that
certain provisions of the Juab County Zoning Ordinance
needed clarification and that a change in Outdoor
Advertising Regulations was necessary.
"The planning commission recommended the minor
revisions be made to the Juab County Zoning Ordinance," he
said.
Following the hearing, county commissioners determined
that the proposed revisions were in the best interests of
Juab County and the health, safety and general welfare of
its citizens and to adopted them.
"Some things were just not clear in the ordinance,"
said Greenhalgh.
One of the revisions had to do with clarifying what
should be done in the case of a developer seeking a zone
change prior to a potential property purchase.
"It seemed clear that the rights of the proper owner
should be protected but that the applicant shouldn't have to
buy the property in order to find out whether or not the
proposed use would be allowed and the change in zoning
authorized," he said.
Therefore, he said, the planning commission was
suggesting the zoning ordinance be amended.
Now an application for a conditional use permit will
be made to the administrator by the property owner or shall
be accompanied by a notarized letter from the property owner
giving the applicant the right to apply for the permit.
Another amendment had to do with approval of
wastewater disposal systems.
"It is not always approved by the Central Utah Health
Department," said Greenhalgh. "We have found that some waste
water systems must be approved by a state agency."
A third amendment is that all appeals from decisions
of the planning commission regarding conditional use permits
will be heard and decided by the legislative body which is
the county commission.
Appeals will be filed with the Juab County Clerk
within 30 days of the approval or denial of the conditional
use permit by the planning commission. The appeal will be
barred if filed more than 30 days after the planning
commission has made its final decision.
"The planning commission is recommending that Section
4, dealing with Juab County Zoning Ordinance, 12-1-2207,
subsection 6, relating to Outdoor Advertising Signs
(Billboard), be deleted in its entirety," said
Greenhalgh.
The planning commission spent a great deal of time
working on the advertising and billboard prohibition and
considering the ramifications of such a ban.
It was found that the state had jurisdiction over
freeway billboards, said Greenhalgh. "We cannot change that,
so the planning commission suggests the ban be deleted from
the ordinance.
The zoning ordinance, now consisting of a total of 168
pages and has been published as a code in book form, will
not need to be published in the newspaper in its entirety,
said Greenhalgh.
The changes to the ordinance will, however, be
published in the newspaper.
In addition,three copies have been filed for use and
examination by the public in the office of the clerk of Juab
County.
The changes to the ordinance are effective
immediately.
