Nephi and Levan are in the process of approving a lease
agreement of the old Nephi garbage truck for Levan's
use.
The 1993 garbage truck will be leased to Levan for $1
per year with Levan agreeing to make the truck available
when needed to serve as a back-up collection truck in
Nephi.
"Both cities will benefit from the agreement," said
Denton Hatch, Nephi City attorney. "At this point, Levan
shoulders the responsibility of making all necessary repairs
to the tuck and to put it in service and agrees to perform
required maintenance and repair to keep the truck in good
operating condition."
The agreement between the two communities will
rollover each year unless either party opts out by giving
the other 30 days notice.
"It does obligate both communities to one year," said
Randy McKnight, city administrator.
Levan will carry the appropriate liability insurance
and property damage insurance on the vehicle and the
agreement does not contemplate that Nephi will provide
back-up collection service to Levan.
The agreement states that it is in the best interest
of the citizens of both communities to have the truck in
good repair and usable and, therefore, the agreement is
mutually beneficial.
One question bothered Brent Bowles, council member, he
wanted to know what would happen if the truck engine because
worthless a short time after the agreement was made.
Major mechanical problems were not anticipated, said
Hatch, however, the way the agreement had been worded, the
responsibility for repair would be on Levan.
In agreement also states that, since Denton Hatch is
the attorney for both cities, both parties wave any conflict
that may occur because Hatch drafted the agreement.
Council members agreed to authorize Chad Brough, Nephi
mayor, to meet with Levan council members and continue to
negotiate the lease agreement and then, when the agreement
is satisfactory to all parties, authorized Brough to sign
it.
