Juab County, along with the Central Utah Counseling
Center, the State of Utah, and several individuals, is being
sued by the parents of a young man who hung himself from a
tree at a private residence in the northeast section of
Nephi.
"Basically, as I understand it at this point, they are
charging that no one made the proper response to the young
man's needs," said Wm. Boyd Howarth, county commission
chair.
Juab County Commissioners received word of the request
for a prelitigation review in the case before the Division
of Occupational and Professional Licensing Department of
Commerce, State of Utah.
Parents of Bryan R. Davis, the dead youth, Robert L.
Davis and Jenean Brothers, are being represented by Jeffrey
N. Aldous of Daigle, Sullivan, Dupre, & Aldous,
Provo.
"We will discuss this action with Central Utah
Counseling Center officials and with the attorneys who
represent us in this type of action (lawsuits)," said
Howarth.
Provisions of the Utah Health Care Malpractice Act,
allow petitioners to request a prelitigation panel review of
medical malpractice claims. That review is made by the Utah
Department of Commerce.
The first request filed, Sept. 6, 2000, was found
defective because the prelitigation filing fee of $60 was
not submitted. Therefore, the request was made a second time
and, this time, the fee was paid.
A Notice of Intent to Commence Action has been served
upon each of the health care providers and entities named by
the petitioners.
Dr. Robert Jeppson, D.O.; Clark Holladay; David Dye;
Debbie Sperry; John Reeves; and Ed Kren, were all served in
addition to Juab County, Jan Graham, attorney general, for
the State of Utah, and Central Utah Counseling Center.
"I will need to figure out exactly what all of this
means, in consultation with our attorneys and with Central
Utah Counseling Center personnel before I will make a
comment," said Howarth.
