The discussion of stop signs in Levan was opened again
because of citizens concerns. Council members had been
contacted since the May meeting by citizens objecting to
stop signs. Speed bumps or dips were thought to be better
options because of the problem of enforcement.
Sheriff Dave Carter said Levan gets good enforcement
for the $100 per month that is paid for law enforcement to
the Juab County Sheriff's Department.
Sheriff Carter suggested having a designated road for
four-wheelers to get in and out of town. Second West and the
canyon road were said to be good possibilities for such
designated roads.
Ed Sorenson suggested hiring a Town marshal and giving
him a percentage of the tickets he writes. Sorenson said you
can pass all the laws in the world but they won't do a bit
of good unless you enforce them.
Mayor Robinson said you can make a citizen's complaint
and give the license plate number to the Sheriff's office
and they will write the ticket.
A motion was made that the stop signs approved in a
previous meeting will be put on hold because of citizen
complaints and so the feasibility of constructing speed dips
can be looked in to. It passed.
Matt Harper recently purchased the property on
the corner of 4th South and 2nd West and wanted to know how
wide the road will be and how much property he would need to
deed to the town for the road. Janet Carter of the Planning
and Zoning Committee recommended that Harper deed 15 feet on
200 West and additional feet on 400 South to provide for a
66 foot road.
A lengthy discussion followed on whether the road
should be 99 feet or 66 feet. There are many problems all
over Levan with the inconsistency of the width of roads.
A motion was made to accept the recommendation of the
Planning and Zoning Committee. The motion passed. Levan Town
needs to be responsible to get the deed recorded. "So let it
be done, so let it be written. It needs to be surveyed and a
description be written," stated Mayor Robinson. After more
discussion, Mayor Robinson decided that a description could
be written by Mary Lou Sperry and the property deeded to
Levan.
The problems with the size of the road on 600
East going toward the cemetery were discussed. Mayor
Robinson said, "Now that Ryan Aagard is on the council and
had a full understanding of the problems in that section of
Levan and of that road, so let it be done, so let it be
written. Ryan is taking care of it." Aagard was assigned to
take care of getting a 66 foot road to the cemetery.
Rod Wankier brought up the problems on 500
South. Mayor Robinson said, "I'll take care of it. I had
talked to Ludlows two weeks ago and they have it about
wrapped up. Ludlows are writing descriptions of that area."
There are many problems with what has gone on in the past
concerning the size of the road on 500 South.
Sorenson said that a legal precedence had been set
when a 50-foot road was granted to the Golden Mangelson
subdivision. If you let Mangelson do it, you've got to let
everyone do it.
Robinson said that the document that was signed and
recorded was 20 feet off, and that is the dilemma.
The 1999-2000 budget was opened and amended.
More funds were given to the Class C road funds. It raised
from $29,000 to $40,300. A $21,000 grant from the Eccles
Foundation for the park equipment was not anticipated. From
Juab County, there was about $20,000 more than anticipated
for fire fighting. It was moved that the final budget
numbers be approved.
It passed.
It was also moved that the budget for 2000-2001 be
approved.
It passed.
Several building permits were approved by the
Planning and Zoning Committee. Permits were approved for
Travis and Kelly Rosquist for a modular home, Doug and
Michelle Jensen for a garage, Matt and Rayni Harper for a
home with approval of the council, the Batemans for a home,
Gloria Romano for a modular home.
Mike Kramer had concerns about the management of
the Town, and the issue of the Mayor handling the road on
500 South and other items. The mayor is handling the
business of the Town and it should be handled by the
council. Mayor Robinson said the management problems will be
handled in executive session and council members were
encouraged to have more input. Mayor Robinson stated that
all five members of the council are equal members. Each one
has a vote, including the mayor.
The League of Cities and Towns will come and
train the council and there are meetings that can be
attended. The duties of the council needs to be explained.
Craig Worwood had ordered books from the League of Cities
and Towns for the council.
Sorenson stated that a standard operating
procedure should be written for each office. Mayor Robinson
invited Sorenson to put his name on the ballot. The Mayor
said that they were busy people. Kramer said that did not
wash with him, you put what time is needed to complete the
job when a responsibility is taken on.
Mayor Robinson asked Kramer if he felt that the Town
Council was falling short of its responsibilities. Kramer
answered, "Yes." "With what regard," asked Robinson. "Let me
list 29," said Kramer. He was referring to the 29 items on
the management letter from Greg Ogden.
Mayor Robinson said that someone is being paid to take
care of 25 of those responsibilities and that will be taken
care of in executive session. Kramer said, "You are passing
the buck."
"No, we are going to take care of it, if the
individual will not take care of it then we will find
someone who will," stated Mayor Robinson.
Kramer stated that Robinson was the CEO of the Town
and was ultimately responsible.
Shurtz moved to go into executive session. It was
seconded and a unanimous vote was taken.
After reconvening, council member's concerns
were heard. Craig Worwood said that Congress had established
a SRF program. He was applying for grant money to improve
the water system in Levan. Worwood is suggesting that all
the 4-inch and 6-inch pipe be replaced. He also thanked
Julie Smalley for her service to the town as cemetery
caretaker.
Ryan Aagard said that Levan had agreed to sign the
resolution to reduce taxes in the Town by $5,000. This will
create a fire district and the county will increase taxes by
$5,000 to cover it.
Andrew Robinson encouraged council members to attend
the League of Cities and Towns.
Jason Worwood complimented the Mayor on all he does
for the Town. He also complimented Craig Worwood for his
service to the Town. He encouraged all council members to
participate more.
Alden Shurtz asked that the front area of the park be
maintained and maybe look into a trash container being
placed there.
Rod Wankier discussed the lawn mower purchase. He has
received bids from Jenkins in Nephi for a 525 John Deere
mower. Jason was assigned to finish up on getting the
mower.
Andrew Robinson stated that the July meeting will be
moved to the second week of July (July 12, 2000).
