OLYMPIC BANNERS - Nephi City has approximately 65 Olympic

ORDINANCE NO 5/5/02 TIME-OF-DAY WATERING ORDINANCE Nephi
City A Municipal Corporation AN ORDINANCE AMENDING THE
MUNICIPAL CODE TO PROMOTE WATER USE EFFICIENCY IN AMENITY
LANDSCAPE IRRIGATION. Section 1. Preamble A. WHEREAS,
Nephi City desires to promote efficient sprinkler
irrigation practices for all plants and land; and B.
WHEREAS, research has shown that irrigating only during
the hours of 6:00 p.m. to 10:00 a.m. significantly
increases irrigation efficiency; and C. WHEREAS,
conservation of water through more efficient use is in
the public interest and enhances the community's economic
environmental, recreational and aesthetic resources,- and
D. WHEREAS, Nephi City has the authority to adopt this
ordinance pursuant to Utah Code Annotated 10-3-702, and
hereby exercises its legislative powers in doing so;
Section 2. Ordaining Clause NOW THEREFORE, be it ordained
by Nephi City that the following ordinance be enacted. -
Section 3. Time-of-Day Watering Parameters Sprinkler
irrigation of public or private land and plants with
water from Nephi Pressurized Secondary Water System and
Nephi City Culinary Water is prohibited between the hours
of 10:00 a.m. and 6:00 p.m. Section 4. Applicability of
Time-of-Day Watering Ordinance The provisions of this
ordinance shall apply to all plants and land within the
city. This ordinance does not apply in the following
situations: a. New lawns that require frequent irrigation
for establishment purposes within 90 days of planting. b.
Short cycles required for testing, inspecting and
maintaining irrigation systems. c. Other situations as
permitted by the city. Section 5. Penalty Violation of
this ordinance is a Class C misdemeanor, which is in part
as set forth in Utah law, punishable by a fine up to
$750.00. Section 6. Effective Date This ordinance shall
