ORDINANCE NO. 3/18/03 ORDINANCE NO 3/18/03 AN ORDINANCE
AMENDING CHAPTER 12-1400 COMBINED USE DISTRICT CU-2
WHEREAS, Nephi City Council has authority to amend its
zoning ordinance pursuant to Sections 10-9-401 and 403
and Section 10-3-701; and WHEREAS, Nephi City Council
finds that an amendment to zoning ordinance 12-1400 is in
the best interest of the City and its citizens; It is
hereby ORDAINED by the Nephi City Council as follows:
Chapter 12-1400 COMBINED USE DISTRICT CU-2 is amended as
follows: 12-1401 PURPOSE Combined Use-11 District DU-2 is
established as a buffer district between more intensive
commercial and residential districts. This district shall
be used in limited areas to provide buffering where it is
determined by the Legislative Body that such buffering is
necessary and is consistent with the General Plan.
12-1402 USE REGULATIONS In Combined Use-II District CU-2
no building or land shall be used, and no building shall
be erected which is arranged, intended, or designed to be
used for other than one or more of the following uses. 1.
Agriculture 2. Dry Cleaning Establishment 3. Laundromat
4. Office, Business or Government or Professional 5.
Parking Lot, Public or Private 6. Personal Services 7.
Preschool 8. Public Park and Recreation Facilities 9.
Public Service 10. Public Utility Station 11. Repair
Service 12. Single-Family Dwellings 13.
Two-Three-and-Four-Family Dwellings 14. Wholesale,
Warehouse, Storage 12-1403 AREA AND DENSITY REGULATIONS
The minimum lot area for single-family dwelling shall he
not less than 8,000 square feet. 12-1404 FRONTAGE
REGULATIONS For dwellings, frontage shall be at least 70
feet at the required front yard setback line. There shall
be no minimum frontage requirement for non-residential
uses, except that frontage development for the CU-2
District shall conform to regulations contained in
Section 12/2001 (2). 12-1405 YARD REGULATIONS 1. Side
Yard. The minimum side yard for dwellings shall be 8
feet, with combined side yards of not less than 18 feet.
On corner lots the required side yard abutting the street
shall be 20 feet for main and accessory buildings.
Commercial buildings that abut a residential use shall
have minimum side yard of 10 feet on the side of the
building adjacent to the residential use other commercial
uses shall have a minimum side yard of 5 feet. Accessory
buildings shall have a minimum side yard of one foot. 2.
Front Yard. Minimum front yard setbacks for dwellings
shall be 30 feet, and for all other uses in the CU-2
District shall be 20 feet, and development within the
front yard areas shall comply with provisions of Section
12-2001. Accessory buildings shall be set back at least
10 feet from the main building. 3. Rear Yard. The minimum
rear yard for all main buildings shall be 30 feet for
dwellings and 15 feet for all other uses. Accessory
buildings shall have a minimum rear yard of one (1) foot.
12-1406 MULTIPLE FAMILY DWELLINGS SPACING REGULATIONS No
Two-Three-or Four Family Dwelling shall be located closer
than 750 feet from another Two-three-and Four-Family
Dwelling. 12-1406 LARGE ACCESSORY BUILDING Large
accessory building not located 10 feet behind the main
building maybe located upon the same lot as a residence,
however, the following regulations shall apply. 1. Front
Yard. The minimum setback for a large accessory building
shall be 30 feet. 2. Rear Yard. The minimum rear yard a
large accessory building shall be 30 feet. 3. Side Yard.
The minimum side yard for a large accessory building
shall be 20 feet. 4. Separation. There shall be a minimum
of 16 feet between the main building and a large
accessory building. 12-1407 HEIGHT REGULATIONS No
building shall be erected to a height greater than 6
stories or 75 feet. Plans for all structures that are
intended to be higher than 35 feet shall be reviewed by
the planning commission. The planning commission shall
deliver its recommendation to the legislative body for
approval or disapproval. 12-1408 COMMERCIAL SITE
DEVELOPMENT The development of all sites for commercial
use shall follow performance standards contained in
12-2000. The planning commission at site plan review
shall approve site development. 12-1409 OUTSIDE STORAGE
Outside storage shall be completely screened by
landscaping or opaque fencing, from view from any public
street or abutting properties This does not apply to
representative displays of materials for sale but does
apply to general inventories, miscellaneous merchandise,
stockpiles, etc. EFFECTIVE DATE This Ordinance shall take
effect immediately when approved by a majority vote of
the members of the governing body this 18 day of March,

ORDINANCE NO. 4/1/03 AN ORDINANCE ADOPTING THE NEPHI CITY
ZONING ORDINANCE WHEREAS, Nephi City Council has
authority to adopt zoning ordinances pursuant to §
10-9-401, 402, and 403; and WHEREAS, Nephi City Council
directed the Nephi City Planning Commission to review the
Nephi City Zoning Ordinance and make recommendations to
the ordinance; and WHEREAS, the Nephi City Planning
Commission has viewed the Zoning Ordinance and made
recommendations for an amended Zoning Ordinance; and
WHEREAS, Nephi City has complied with all legal
requirements for public hearings and notice to adopt an
amended Zoning Ordinance; NOW, THEREFORE, BE IT ORDAINED
that the attached amendment to the Nephi City Zoning
Ordinance be adopted and, to protect the welfare of the
City, shall become effective immediately. BE IT FURTHER

HUMAN SERVICES REQUEST FOR PROPOSALS Request for
proposals may be obtained from the State of Utah,
Department of Human Services, Bureau of Contract
Management, 120 North 200 West, and room 213 Salt Lake
City, Utah 84103. A mandatory pre-proposal conference
will be held April 9, 2003. Bids will close at 3:00 PM
May 6, 2003 on the following: DHS/DCFS #60261 This is an
invitation to submit a proposal for services with the
Division of Family Services to provide counseling and
court coordination to perpetrators and victims of
domestic violence to intervene and prevent further family
violence. This service is for Utah, Juab, and Millard
Counties. The Department reserves the right to reject any
or all proposals; or to accept or reject the whole or any
part of any proposal; or to waive any informality or
technicality in any proposal in the best interest of the
State. Only proposals giving a firm quotation properly
signed will be accepted. Proposals and specifications

SPECIAL BOARD MEETING The Board of Education of the Juab
School District will meet in a special work meeting on
April 15, 2003 at 6:30 PM at the Juab School District
