ORDINANCE NO. 032900

AN ORDINANCE DECLARING THE ANNEXATION OF TERRITORY TO THE MUNICIPALITY OF MONA TOWN IN T14E AREA LOCATED BETWEEN 100 NORTH AND 150 SOUTH (PLATT LANE) GOING EAST APPROXIMATELY 2,060 FEET FROM THE EXISTING MONA TOWN EAST BOUNDARY.

WHEREAS, the owners of the majority of real property and the owners of 100 percent of the value of the real property as shown on the last assessment rolls in territory lying contiguous to this municipality have petitioned this municipality for annexation; and

WHEREAS, the petition was accompanied by an accurate plat or map of the territory to be annexed prepared under the supervision of a competent surveyor and certified by the surveyor, and

WHEREAS, the petition and plat or map have been filed in the office of the municipality recorder.

It is hereby ORDAINED by the Mona Town Council as follows:

Section 1. Territory Annexed. The territory described in Exhibit "A" is hereby declared annexed to the municipality.

ORDINANCE NO.4-17-2000A

WHEREAS, the Little Sahara Recreational Area is a popular recreation in Juab County; and

WHEREAS, the popularity of the recreation site generates large gatherings of people; and

WHEREAS, because of the large crowds of people which gather, the law enforcement officials have experienced problems because of the large numbers with alcoholic beverage, glass bottles, and large bonfires; and

WHEREAS, the traditional Easter weekend is a high traffic weekend for visitors at the Little Sahara Recreational Area; and

WHEREAS, the County legislative body has authority pursuant to Utah Code Annotated Section 17-15-1(6) to enact ordinances for immediate effect upon publication when an emergency is present; and

WHEREAS, the Juab County Commission specifically finds that for the health, safety, and general welfare of Juab County it requires that certain restrictions be provided at the Little Sahara Recreational Area.

NOW, THEREFORE BE IT ORDERED as follows: That Title 11-7 of the Juab County Ordinances be created to read as follows. Chapter 11-7. Little Sahara Recreational Area

11-7-1. Definitions.

11-7-2. Effective Date.

11-7-3 Prohibitions.

11-7-4. Penalties.

11-6-1. Definitions.

(a) Little Sahara Recreation Area is defined as the area within the legal boundaries of the Bureau of Land Management's Little Sahara Recreation Area.

(b) Large bonfires means for purposes of this ordinance, a fire with flames over three feet tall or fires which cannot be contained in a three foot diameter.

(c) Wooden pallets for purposes of this ordinance means any two or more pieces of wood affixed together by use of nails or wire.

11-7-2. Effective Date.

This ordinance becomes effective immediately upon publication in the The Times-News, Nephi pursuant to Utah Code Annotated 17-15-1 (6).

11-7-3. Prohibited Acts.

(a) It shall be unlawful within the Little Sahara Recreational Area to possess glass containers outside of vehicles, camp trailers, or tents.

(b) It shall be unlawful for any person to knowingly create or maintain any large bonfire within the area of Little Sahara Recreational Area.

(c) It shall be unlawful for any person to bring into the Little Sahara Recreational Area or to possess within the Little Sahara Recreational Area any pallets or lumber or wood products with nails or other metal objects affixed to such wood, lumber or wood products.

11-7-4. Penalties.

(a) A violation of 11-7-3 (a) is a class C misdemeanor.

(b) A violation of 11-7-3 (b) is a class B misdemeanor.

(c) A violation of 11-7-3 (c) is a class C misdemeanor.

PUBLIC HEARING

The Juab County Commission will hold a public hearing on Monday May 1, 2000 at 2:30 PM in the Juab County Commission Chambers. The purpose of the hearing is to receive public comment on a request from Schofield-Andrews to change their property Serial # XB2299-2 located at the intersection of the Airport Road and State Highway 132 from A-1 to C-1 Commercial.
