NOTICE OF REFUNDING BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN pursuant to the provisions of Section 11-27-4, Utah Code Annotated 1953, as amended, that on February 1, 2001, the Board of Education of Juab School District, Juab County, Utah (the “Board”), adopted a resolution (the “Resolution”) in which it authorized and approved the issuance of its General Obligation Refunding Bonds (Utah School Bond Guaranty Program), Series 2001 (the “Refunding Bonds”), in an aggregate principal amount of not to exceed Nine Million Dollars ($9,000,000), to bear interest at a rate or rates of not to exceed seven percent (7.00%) per annum, to mature in not more than twenty (20) years from their date or dates and to be sold at a discount from par, expressed as a percentage of principal amount, of not to exceed two percent (2.00%). The purchaser will not be required to make a good faith deposit in connection with its agreement to purchase the Refunding Bonds. Pursuant to the Resolution, the Refunding Bonds are to be issued for the purpose of raising money for refunding the Board’s $8,205,000 currently outstanding General Obligation School Building Bonds, Series 1996, dated February 15, 1996, which mature on June 15, on and after June 15, 2007 through and including June 15, 2016 (the “Refunded Bonds”). The maximum aggregate principal amount of the general obligation bonds of the Board to be refunded is $8,205,000. The principal amount of the Refunding Bonds may exceed the principal amount of the Refunded Bonds. The Refunding Bonds are to be issued and sold by the Board pursuant to the Resolution, including as part of the Resolution the draft of a final refunding bond resolution that was before the Board and attached to the Resolution in substantially final form at the time of the adoption of the Resolution. The Board is to adopt that final refunding bond resolution in such form and with such changes thereto as the Board shall approve upon the adoption thereof, provided that the principal amount, interest rate or rates, maturity and discount will not exceed the respective maximums described above. A copy of the Resolution (including the draft of the final refunding bond resolution attached to the Resolution) is on file in the office of the Business Administrator of Juab School District at 42 East 200 North, Nephi, Utah, where the Resolution may be examined during regular business hours of the Business Administrator from 8:00 a.m. to 5:00 p.m. The Resolution shall be so available for inspection for a period of at least thirty (30) days from and after the date of the publication of this notice. NOTICE IS FURTHER GIVEN that pursuant to law for a period of thirty (30) days from and after the date of the publication of this notice, any person in interest shall have the right to contest the legality of the above-described Resolution (including the final refunding bond resolution attached thereto) of the Board or the Refunding Bonds authorized thereby or any provisions made for the security and payment of the Refunding Bonds.
