Levan Town council members will decide whether or not
to enforce the Nuisance Ordinance in town after a few
residents complained about a certain property owner in
town.
Four neighbors wrote a letter to the council asking
that something be done about their neighbor and the "junk"
on his property. They stated that this person's yard could
potentially devalue their property, and they want the
council to do something about it. They referred to Ordinance
Chapter 10-300, Part 10-313, 10-321, 10-330, 10-333.and
10-334.
Mayor Bob Shepherd said that if they did decide to
enforce the ordinance then they would also have to crack
down on others who were not in accordance.
Janet Carter stated that the council needs to "tread
lightly" while making a decision and felt that it wouldn't
be fair if one person was singled out while others were
not.
Cory Christensen, council member, said that the
council should also consider the feelings of the disgruntled
neighbors.
One resident said that this person could ultimately
seek a business license for a "perpetual yard sale" and not
clean up the property.
"There's a point where you have to decide which is
which," said Mayor Shepherd.
Shepherd said that the ordinance was in place to keep
properties from being devalued because of this problem with
unkempt yards and "junk."
The council decided that the first step would be to
talk to the resident in question and see if anything could
be done. They said that if the resident wouldn't comply then
the council would have to consider further action.
