The recent council decision to amend the zoning
ordinance will now require council members to consider
amending the city business license ordinance.
"We changed the zone dealing with a academies," said
Mayor Chad Brough. "Now we need to change the business
license ordinance to bring it up to date."
Denton Hatch, city attorney, had prepared an amendment
for council members to accept and for the mayor to sign at
Tuesday's council meeting.
"We need to amend the licensing and regulations
ordinance to be consistent with the zoning ordinance," said
Brough.
Two exceptions were allowed for the business
ordinance, which requires that all who engage in any
business, trade, profession or calling for which a license
is required, must have a license before beginning
business.
"Any business keeping less than five children for care
is not included in the definition of day care and is not
regulated by the city," said Brough.
In addition, any business that instructs students in a
dwelling in music, art, crafts, academies, dance or
kindergarten preparation, whether or not for compensation,
where no more than 16 students are present in any one
session and sessions are less than four hours in duration
and where instruction is given by the resident of the
dwelling and no one else is employed do not need a business
license.
"The remainder of the ordinance remains as it is
written," said Brough.
The amendment became effective immediately after the
council approved it and the mayor signed it.
